What this policy covers
This TCPA Policy describes how Duck River Home Buyers(“we,” “us”) obtains and honors consent for marketing communications — including phone calls, text messages (SMS), and emails — under the Telephone Consumer Protection Act (47 U.S.C. § 227), the CAN-SPAM Act, related FCC and FTC regulations, and applicable Tennessee state law.
The consent you provide
When you submit a form on our Site, the following exact consent disclosure is displayed alongside a required checkbox:
“By submitting this form and clicking ‘Request My Free Review,’ I agree to receive marketing calls, texts, and emails from Duck River Home Buyersat the phone number and email I provided, including via automated technology. Consent is not a condition of any purchase. Message and data rates may apply. I can opt out at any time by replying STOP. See our Privacy Policy and TCPA Policy.”
Submission of the form, with the checkbox affirmatively checked, constitutes your “prior express written consent” under TCPA rules. We store a timestamped record of the exact disclosure text shown to you at the time of submission.
What you’re consenting to specifically
- Phone calls from Duck River Home Buyers or our authorized agents to the phone number you provided, including calls made using automated dialing technology or pre-recorded voice messages
- SMS text messages from Duck River Home Buyers or our authorized agents to the phone number you provided, including messages sent using automated technology
- Email communications from Duck River Home Buyers to the email address you provided
- Communications related to your specific inquiry about selling your property, as well as related marketing communications about our services
Consent is not a condition of purchase
You are not required to provide consent to receive marketing communications as a condition of any property sale or other transaction with us. You may decline consent and still contact us by phone or email directly.
How to opt out
You can revoke your consent and stop receiving communications at any time:
- To stop text messages: reply STOP to any text message you receive from us. You will receive a confirmation message and no further texts.
- To stop phone calls: tell us during any call that you wish to be placed on our internal Do Not Call list, or email us at legal@duckriverhomebuyers.com with the phone number to remove.
- To stop emails: click the unsubscribe link in any marketing email, or email us at legal@duckriverhomebuyers.com.
- To stop all communications: email us at legal@duckriverhomebuyers.comwith “REVOKE CONSENT” in the subject line and the phone number and email you wish to remove. We will process your request within 10 business days.
Message and data rates
Standard message and data rates may apply to text messages from us, depending on your mobile carrier and plan. We do not charge for our messages.
Frequency
Message frequency varies depending on your inquiry and our follow-up process. You will typically receive no more than a handful of messages in connection with any single inquiry.
Our records
For each form submission, we retain: (a) the exact text of the consent disclosure you agreed to, (b) the timestamp of your submission, (c) a hashed record of your IP address, and (d) the page on our Site where you submitted. This record allows us to demonstrate compliance with TCPA requirements if challenged.
Internal Do Not Call list
We maintain an internal Do Not Call list of phone numbers that have requested no further contact. Once a number is added to this list, we will not contact it for marketing purposes. You can request to be added by emailing legal@duckriverhomebuyers.com.
Disputes
If you believe you have received a communication from us in violation of this policy or applicable law, please contact us immediately at legal@duckriverhomebuyers.com so we can investigate and address the issue.
